1. Scope of Application
These General Terms and Conditions (GTC) of Temporex Lifestyle GmbH, Hinsbecker Löh 10, 45257 Essen, Germany (hereinafter the “Seller”) apply to all contracts concluded by consumers within the meaning of Section 13 of the German Civil Code (BGB) via the Seller’s online shop.
Sales are made exclusively to consumers. Orders placed by entrepreneurs within the meaning of Section 14 BGB, for commercial purposes or for resale, are excluded. The Seller is entitled to reject or cancel such orders.
Translations of these GTC into other languages are provided for convenience only. The German version is the sole authoritative and legally binding version.
2. Conclusion of Contract; Ordering Channel
The presentation of products, in particular in the online shop, does not constitute a binding offer. Images and descriptions may deviate within reasonable limits and constitute a defect only if the suitability of the product is materially impaired.
Orders may be placed exclusively via the online shop. Orders by mail, fax, or email are not accepted.
Before submitting an order, the customer is provided with an order overview enabling review and correction of all details. By clicking the order button, the customer submits a binding offer to conclude a purchase contract.
The contract is concluded upon the earliest of the following events:
- dispatch or order confirmation,
- charging of the payment method or payment instruction (for example PayPal, Klarna), or
- delivery of the goods.
The Seller may accept the offer within five days. If no acceptance occurs within this period, the offer is deemed rejected.
The Seller stores the contract text. The GTC, cancellation policy, and order data are sent to the customer by email. The contract language is German.
2a. Orders to Switzerland
For orders delivered to Switzerland, the purchase contract is concluded between the customer and MeinEinkauf AG, St. Gallen, Switzerland (CHE-331.561.017 MWST).
MeinEinkauf AG handles customs clearance, invoicing, and delivery within Switzerland. These services are included in the purchase price and any applicable shipping costs.
For transparency, the customer is informed that MeinEinkauf GmbH, Constance, Germany (DE285677365), is involved in the supply chain. This does not result in any additional costs for the customer.
3. Prices and Payment Terms
All prices are final prices including statutory value added tax. Any shipping costs are displayed during checkout.
For deliveries to non-EU countries (other than the United Kigdom), additional customs duties, taxes, and fees may apply and are borne by the customer.
The payment methods offered during checkout (for example credit card, PayPal, Klarna, Sofort) are available. The respective payment service providers’ terms also apply.
4. Retention of Title
The goods remain the property of the Seller until full payment has been received.
5. Delivery and Shipping
Delivery is made to the address specified by the customer. For payments via PayPal, the delivery address stored with PayPal may be decisive.
Additional costs resulting from incorrect address details or failed delivery are borne by the customer if attributable to the customer. Statutory rights, in particular in the event of exercising the right of withdrawal, remain unaffected.
Self-collection is excluded.
The delivery countries, delivery times, shipping costs, and any applicable Incoterms published in the “Shipping & Delivery” policy apply. This policy forms an integral part of the contract.
The Seller is entitled to ship orders in multiple parcels. For each parcel, a separate contract for the goods confirmed therein may be concluded with a separate shipping confirmation.
6. Pre-Orders and Delivery Date Information
The online shop may offer products that are not yet available at the time of ordering (pre-order or backorder).
An estimated availability or delivery date may be displayed on the product detail page. This date is for guidance only and does not constitute a binding commitment.
Shipment takes place once the goods are available. In the event of a material delay, the customer will be informed without undue delay. In such case, the customer has the statutory rights, in particular withdrawal or rescission in accordance with statutory provisions.
Acceptance of the offer by the Seller for pre-order products also occurs only in accordance with Section 2 of these GTC.
7. Right of Withdrawal and Voluntary Return Policy
Consumers have the statutory right of withdrawal (14 days). The content and exercise of the right of withdrawal, including the model withdrawal form, are governed exclusively by our “Returns & Refunds (Withdrawal)” policy, which applies in the version valid at the time of ordering and is provided to the customer in text form.
8. Return Shipping Costs and Return Labels
Details regarding return shipping costs, cost coverage, return labels, and the process via the returns portal are governed exclusively by the “Returns & Refunds (Withdrawal)” policy in its respective valid version.
9. Liability for Defects and Warranty
The statutory provisions regarding defects apply.
Independently of this, the Seller grants a three-year warranty for manufacturing defects, provided such warranty is indicated for the product. Details are set out in the product description or service information. Statutory rights remain unaffected.
Customers are requested to report transport damage to the carrier without undue delay and to inform the Seller. Failure to do so does not affect statutory claims.
10. Liability
The Seller is liable without limitation for intent and gross negligence, as well as for injury to life, body, or health.
In cases of slight negligence, the Seller is liable only for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, contract-typical damage.
Liability under the Product Liability Act and any assumed guarantees remain unaffected.
The above provisions also apply in favor of the Seller’s legal representatives, employees, and vicarious agents.
11. Promotional Vouchers
Promotional vouchers are subject to the conditions specified in each case (for example validity period, minimum order value, exclusions, combinability). Cash payment is excluded. Retroactive application to orders already placed is not possible.
12. Gift Vouchers
Gift vouchers purchased for value are transferable and not redeemable for cash, except where required by law. Refunds are issued in the form of a voucher. Validity is three years from the date of purchase, where legally permissible.
13. Order Quantities, Resale, Pricing Errors
The Seller reserves the right to reject or cancel orders involving unusual quantities or suspected resale.
In the event of obvious pricing or typographical errors, the Seller is entitled to correct such errors and cancel affected orders. Payments already made will be refunded without undue delay.
14. Governing Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.
15. Jurisdiction
For consumers, the statutory places of jurisdiction apply.
16. Consumer Dispute Resolution (Section 36 VSBG)
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
17. Severability Clause
Should individual provisions of these GTC be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected. In place of the invalid or unenforceable provision, the statutory provision applies where available (Section 306 BGB). The same applies in the event of a regulatory gap.
